This Privacy Policy reinforces the commitment of Gustavo Tepedino Advogados (“GTA” or “office”) to guarantee the privacy and protection of personal data of all individuals whose information is processed, such as users of its website, clients individuals, representatives, partners or any other individuals related to corporate clients, and GTA employees (“user”, “owner” or “you”).

GTA has established this Privacy Policy in accordance with the General Law for the Protection of Personal Data (“LGPD” – Law No. 13,709/2018) and other relevant rules, as well as in compliance with its internal information security guidelines and its good governance practices, to provide you with a clear and detailed understanding of how the firm uses and processes data and personal information.

The GTA website is not intended for persons under 18 years of age. Any submission of personal data of children must necessarily be accompanied by the specific consent of their legal guardian.

PROCESSED PERSONAL DATA CATEGORIES

The office collects and uses personal data necessary for the performance of its activities, in addition to those required by law to collect.

To the extent permitted by relevant legislation, GTA may process different types of personal data in relation to you, including, but not limited to:

  • identification information, such as full name, address, date of birth, nationality, identification document data (RG, CPF, CNH, OAB card);
  • information on professional and educational qualifications, such as the company you work for, profession, position and education;
  • information related to your digital activity (e.g. IP address, browsing activity, geolocation);
  • family situation, such as number of children and marital status;
  • banking and financial information.
  • GTA may collect this information in a variety of ways. This personal data may be collected directly from you, from someone related to you (eg the company you are a part of) or obtained from publicly accessible sources.
 
 

PURPOSES OF PROCESSING PERSONAL DATA AND LEGAL GROUNDS OF PROCESSING

Personal data may be processed in order to allow the firm to comply with legal and regulatory obligations, to comply with court orders or requests from competent public authorities, to execute a contract or pre-contractual negotiation, to pursue the lawful interests of the firm, to the regular exercise of the right and to respect your choice if consent is required for a specific treatment.

Based on such legal bases, the personal data collected by GTA may be used, in accordance with applicable legislation, for the purposes exemplified below:

  • processing and collection of fees;
  • informative activity on legal news and activities of the firm’s members, through the sending of e-mails or newsletters;
  • in the event of having to deal with sensitive data (information on racial or ethnic origin, religious conviction, political opinion, membership of a trade union or organization of a religious, philosophical or political nature, data relating to health or sex life, genetic or biometric data , when linked to a natural person), the firm may treat them for the regular exercise of rights, including in contract and in judicial, administrative and arbitration proceedings, as permitted by article 11, II, “d” of the LGPD;
  • assessment of compliments, suggestions and complaints, including feedback on our services and initiatives.

  • improving navigation and expanding the user’s interactive experience on the site;
  1. GTA’s legitimate interest:
  • for the protection of GTA’s interests in the context of legal actions or administrative proceedings, to the extent that is strictly necessary for the success of the claim;
  • if the disclosure is strictly necessary to prevent damage or harm to GTA or fundamental rights and guarantees;

SHARING OF PERSONAL DATA

For the purposes indicated, GTA may share personal data, for example, with:

  • providers of software and other information technologies for the purposes of register management, documentation and other measures necessary for the functioning of the GTA;
  • people and organizations that hold information about your application, such as employment and recruitment agencies or your previous employers;
  • providers of support services to the legal activity, such as correspondents, experts, referees, auditors, information technology professionals, companies specialized in backup, appraisers, accounting professionals, notary registrars, translators and financial institutions;
  • service providers of administrative activities, such as accountants;
  • partner law firms;
  • bodies of the Judiciary;
  • public bodies and entities and other public authorities, when the law, regulation or administrative decision obliges us to share such data (for example, tax administration entities, or a certain regulatory authority);
 
 

PERSONAL DATA RETENTION

The firm processes your personal data throughout the legal relationship and they are generally kept for a specified period after the end of the legal relationship, in line with legal regulations. The periods for which GTA retains your data vary depending on the category of personal data and legal and regulatory requirements.

The firm retains your personal data for the time necessary to comply with legal and regulatory requirements, or for a period defined in accordance with our operational obligations, in order to allow adequate accountability, efficient management of the relationship with clients, as well as to respond to the determination of public authorities.

 

RIGHTS REGARDING PERSONAL DATA

GTA will guarantee you, with regard to the treatment of your information and personal data, rights as established in the applicable legislation, notably the LGPD, and in accordance with the deadlines and procedures indicated therein.

Requests to exercise such rights can be sent to the GTA Data Officer via the email lgpd.gta@tepedino.adv.br, with the attachment of a scanned copy of your identity document. GTA will process claims in accordance with internally established procedures and in full compliance with applicable legislation.
